FAIRFIELD COUNTY BANK REWARDS TERMS & CONDITIONS
Addendum to Fairfield County Bank Rewards Terms and Conditions Effective February 1, 2012
 
The Fairfield County Bank Rewards (Rewards) points program will be discontinued effective April 30, 2012. After that date, you will no longer earn reward points for everyday spending when making purchases on your debit card. Effective February 1, 2012, we will no longer issue certificates for reward points for new product and service enrollments. This part of the rewards program is effectively terminated on that date.
 
Generally, our debit card usage points are mailed to our customers each quarter. Because of the termination of the program on April 30, 2012, we will add the additional points earned for the month of April to those earned from January through March, and you will receive a final certificate in May 2012 with all points earned during this four-month period.
 
Points are valid for 2 years from the date of issuance. The specific expiration date for a given certificate is printed on the certificate. The Fairfield County Bank Rewards site will be operational until April 30, 2014. Any outstanding points you may have and wish to redeem must be redeemed by the date printed on the Rewards certificate(s) you have received.
 
Enrollment and Fairfield County Bank Reward Points Redemption
When you wish to redeem your points simply go to www.fairfieldcountybankrewards.com and create a new rewards account. You must have an e-mail address to create an account, if you do not have an e-mail address call our customer service at 1-877-431-7431, and we will assist you by getting a paper redemption form and additional merchandise information as needed. Alternatively, you may call 910-202-3075 to speak directly with the merchandise fulfillment service. You may accumulate your points in your online Fairfield County Bank Rewards account or save your certificates for future use. We suggest that you enter your certificate number into an online rewards account as soon as possible as we do not replace misplaced or lost certificates.

The following terms and conditions describes Fairfield County Bank’s Rewards program, including how reward points are earned for different types of loan account openings and other activity. The terms and conditions also describe how reward points are provided to the account holder, the expiration of the reward certificates and how the reward certificates can be redeemed.
 
Account Opening Rewards (Credit Accounts)
Customers may be awarded rewards points when opening any residential mortgage or Home Equity Line of Credit offered by the Bank. Fairfield County Bank Commercial, Education, Unsecured Lines of Credit, Small Business, or Installment loans do not qualify to earn or be awarded reward points. The Reward Certificate will be awarded and mailed within 45 days of account opening. Account opening for loan accounts is considered the origination date, not the date of application. Reward points are only awarded to originated credit accounts. Credit card accounts opened through Fairfield County Bank’s contracted service provider (First National Bank of Omaha) do not qualify for the reward point program. 
 
The Reward Certificate will specify the date the Reward Certificate expires and where the customer must register the Reward Certificate (see below section for more details). Once a Reward Certificate is registered in a Fairfield County Bank Rewards account they can be redeemed according to the program rules outlined in the sections below. Reward point amount is subject to change. 
 
Ancillary Service Rewards
Customers also have the opportunity to earn Fairfield County Bank Rewards the following ways:
 
·         Debit Card Enrollment
Customers that have a qualified Fairfield County Bank deposit account can order a Debit Card. The act of ordering a new Debit Card for the account may earn the customer a one-time award of reward points. The amount awarded can be referenced in the point reward matrix within this disclosure. Reward point amount is subject to change. Limit one award per new debit card account. Only new Debit Card orders qualify. New card orders to replace old debit cards, or lost/stolen debit cards do not apply. Reward point amount is subject to change. The Reward Certificate may be awarded at the time of debit card application (account opening) or by mail following the account opening. The Reward Certificate will specify the date the Reward Certificate expires and how the customer can register the Reward Certificate (see below section for more details). Once a Reward Certificate is registered into a Fairfield County Bank Rewards Account they can be redeemed according to the program redemption rules outlined in the section below.
 
·          Check Card (Debit Card) Transactions (Signature Based)
Customers can regularly earn reward points for debit card activity. Customers will be awarded 1 reward point for every $100 of debit card transaction activity where the customer was required to validate the transaction by endorsing a merchant transaction receipt at the point-of-sale. A point- of sale transaction is when you use your debit card to purchase goods and services. Reward point amount is subject to change. Certificates for reward points are mailed quarterly.
 
·         Check Card (Debit Card) Transactions (PIN Based)
Customers can regularly earn reward points for debit card activity. Customers will be awarded ½ reward point for every $100 of debit card transaction activity where the customer was required to validate the transaction by entering their Debit Card Personal Identification Number (PIN) via a merchant’s point-of-sale touchpad.ATM transactions do not qualify for reward points.  Reward point amount is subject to change. Certificates for reward points are mailed quarterly.
 
·         Online Banking Enrollment
The act of enrolling for online banking may earn the customer a one-time award of reward points. That amount awarded can be referenced in the point matrix within this disclosure. Limit one award per online banking enrollment. Enrollment must be new to online banking product a reward cannot be earned if any award of points was previously earned for enrollment. Canceling the enrollment and re-enrolling does not qualify for reward points. Reward point amount is subject to change. The Reward Certificate will be mailed within 45 days of enrollment.
·         Online Bill Pay Enrollment
The act of enrolling for online banking Bill Pay may earn the customer a one-time award of reward points. That amount awarded can be referenced in the point matrix within this disclosure. Limit one award per Bill Pay enrollment. Enrollment must be new to online Bill Pay service a reward cannot be earned if any award of points were previously earned for enrollment. Canceling the enrollment and re-enrolling does not qualify for reward points. Reward point amount is subject to change. The Reward Certificate will be mailed within 45 days of enrollment.

Fairfield County Bank Rewards Program Service Provider
Fairfield County Bank utilizes a third party service provider to administer the Premium Privileges Reward Program. Velocity Solutions, Inc. at 1710 Dawson Street, Wilmington, NC 28403 administers the Bank’s  Fairfield County Bank Reward  Program. Additional terms and conditions set forth by this provider are disclosed herein. 
 
 
Service Provider (Velocity) Terms & Conditions
 
Rewards Program Terms and Conditions
Fairfield County Bank (the “Program Sponsor”) has chosen Velocity Solutions, Inc. (“Velocity”) to conduct its Rewards Program in connection with rewards to the Program Sponsor’s customers. Velocity requires that all persons or entities participating in the Rewards Program (each, a “participant”) comply with all terms and conditions set forth below.
 
By redeeming Points, signing up for an account or otherwise using the Rewards Program, you agree that you have read and understand and agree to these terms and conditions, as they may be modified by Velocity from time to time in its sole discretion (the “Rewards Program Terms and Conditions”), and that your use of Velocity’s website and your participation in the Rewards Program is subject to these Rewards Program Terms and Conditions. If you do not agree to be bound by these Rewards Program Terms and Conditions, you will not be able to redeem any Points or participate in the Rewards Program.
 
Velocity reserves the right, in its sole discretion, with or without notice, to modify these Rewards Program Terms and Conditions and any of the rules, procedures and conditions pertaining to the Rewards Program at any time. You are responsible for making sure you have the most current version of the Rewards Program Terms and Conditions at any time. A current version can be obtained by checking this website or by requesting a current copy by mail from Velocity Solutions, Inc., 1710 Dawson Street, Wilmington, NC 28403.
 
Eligible Participants
Only United States residents who are 18 years of age or older and business entities having their principal office in the United States may participate in the Rewards Program. Velocity reserves the right at any time to further limit participation in the program.
 
Redemption of Points
All Points are evidenced by certificates issued by Velocity which contain a unique certificate number and a specific number of Points. Points are redeemed through the Rewards Program website, or by submitting a paper order form which may be obtained from Velocity Solutions, Inc. at 1710 Dawson Street, Wilmington, NC 28403. 
Points may be redeemed only for rewards offered by Velocity and available at the time of redemption. POINTS MAY NOT BE REDEEMED FOR CASH, CHECK OR CREDIT. POINTS HAVE NO CASH VALUE. At the time of redemption participants may be asked for identification suitable to Velocity in its discretion. Participants are responsible for limiting access to their online account only to persons authorized by them.  ALL POINTS EXPIRE ON THE EXPIRATION DATE SET FORTH ON THE CERTIFICATE AND UPON SUCH DATE BECOME VOID. NO REPLACEMENTS WILL BE MADE FOR LOST, STOLEN OR DAMAGED CERTIFICATES. 
Points will be subtracted from a participant's account once the reward is requested and any certificates representing those Points will become void. Once redeemed, a participant may not cancel the order or substitute another reward for the one ordered. No refunds of Points will be made for any reason.
Exchanges of merchandise will be made upon the following terms and conditions:
 
1.       For products which are damaged upon receipt by the participant, the participant may (a) contact member services for the program for assistance, or (b) mail the product to the address specified by Velocity on the return form enclosed with the product delivery or specified on this website and enclose a notation indicating the problem with the product. A replacement product will be sent to the participant (the same product, if it is then available) and the postage required for the return will be refunded to the participant.
2.       For products which are not damaged but for which the participant desires a replacement, the participant may exchange the product for any other product that is currently available for the same number of Points or for a lesser number of Points. If the exchange is for an item available for a lower number of Points, no points will be refunded. The participant may mail the product to the address specified by Velocity on the return form enclosed with the product delivery or specified on this website and must enclose $3.50 for postage and handling. Velocity will replace the returned product with the requested product (if it is then available). The cost of the return postage will not be refunded to the participant.
3.       Notwithstanding anything to the contrary, no returns or exchanges will be accepted for any reason after 90 days from the date of the order.
4.       No points will be refunded or re-deposited in the event of any return or exchange.
5.       If the product requested to be sent as a replacement or exchange product is not available, then Velocity reserves the right to substitute another product of equal or greater value (as determined by Velocity).
 
Velocity strives to maintain adequate inventories of rewards. However, due to fluctuations in supply and other market conditions, items are occasionally discontinued or unavailable. Velocity reserves the right to replace any reward item ordered with an item of equal or greater value (as determined by Velocity). Velocity also reserves the right from time to time to increase the number of Points required for certain items and to correct any errors in Rewards Program catalogs or on Velocity's website without notice.
 
Non-Transferability of Points
Points may not be transferred voluntarily or involuntarily. Points are void if transferred. Points may not be sold, bartered or exchanged. Points are not transferable in the event of a participant's death, bankruptcy or divorce, or otherwise by operation of law.
 
Points Participant Obligations
Participants agree to comply with all applicable laws, rules and regulations. Participants acknowledge that they may only participate in the Rewards Program if and to the extent such participation is permitted by such laws, rules and regulations. Velocity may refuse to enroll a participant, or to restrict, modify or terminate a participant's participation in the Rewards Program, without liability to the participant or any other party, if a participant violates any law, rule or regulation, or if a participant's participation in the Rewards Program could violate any law, rule or regulation.

Participants agree not to abuse Rewards Program privileges by conduct which is detrimental to Velocity or the Program Sponsor, including without limitation attempting to accrue Points or spend Points in a manner inconsistent with Velocity's policies or the intent of these Rewards Program Terms and Conditions, such as attempting to earn Points through other than legitimate channels, participating in purchasing or redemption fraud, or tampering with Rewards Program award links or websites.

Participants agree to provide only accurate and true information to Velocity at all times.   Participants agree to comply with all terms and conditions set forth by Velocity and its programs at all times.

Participants agree to promptly notify Velocity of any change in address (mail or email) by updating their personal information at the Rewards Program website. Participants are responsible for paying all sales, use and other taxes and impositions due or arising in connection with the redemption of Points for rewards and for reporting to and filing with all applicable governmental entities all required returns and reports.

Participants agree that Points must be redeemed prior to the expiration date on the Points certificate, failing which participants agree that such Points are void and not redeemable. Participants agree promptly to dispose of redeemed or expired certificates.
 
Termination of Accounts
Should a participant object to any of the terms and conditions of these Rewards Program Terms and Conditions, or any subsequent modifications thereto, or become dissatisfied with the Rewards Program, the participant's only recourse is to immediately discontinue participation in the Rewards Program and terminate the participant's relationship with Velocity. At such time, all Points will be forfeited. 

Velocity reserves the right to terminate the participation of any participant who fails to comply with this Agreement or who appears to be using the Rewards Program in a manner inconsistent with these Rewards Program Terms and Conditions, the intent of these Rewards Program Terms and Conditions or any Rewards Program rules. In the event of such termination, Velocity may elect to cancel the Points in such participant's account and in any certificates held by the participant representing Points. 

Velocity shall be the sole arbiter in cases of suspected abuse, fraud or violation of its rules and any decision it makes relating to termination of participation (including cancellation of Points) shall be final and binding.

Velocity reserves the right to change, modify or discontinue the Rewards Program with or without notice to the participant. Velocity shall not be liable to the participant should Velocity exercise its right to modify or discontinue the Rewards Program.

Velocity reserves the right to terminate any participant's account if that participant has been inactive for any given period of 24 consecutive months. A participant shall be considered “inactive” for such time as the participant has not added Points or certificates for Points to the participant's account or redeemed Points for rewards. Upon termination of an inactive account, the accrued Points will be cancelled.
 
Disclaimer of Warranties
Participants expressly agree that use of the Rewards Program is at the participant's sole risk.

The Rewards Program and all services offered in connection therewith are provided on a strictly “as is” and “as available” basis. VELOCITY MAKES NO WARRANTY (1) WITH REGARD TO ANY PRODUCTS, SERVICES OR REWARDS OBTAINED BY PARTICIPANTS THROUGH THE REWARDS PROGRAM OR THROUGH VELOCITY'S SUPPLIERS OR SERVICE PROVIDERS; (2) THAT THE REWARDS PROGRAM OR ANY PRODUCTS DELIVERED IN CONNECTION WITH THE REWARDS PROGRAM WILL MEET PARTICIPANTS' REQUIREMENTS; (3) THAT THE REWARDS PROGRAM WILL BE UNINTERRUPTED, TIMELY OR ERROR FREE; OR (4) AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE REWARDS PROGRAM OR ANY PRODUCTS DELIVERED IN CONNECTION WITH THE REWARDS PROGRAM OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED BY THE PARTICIPANT.
VELOCITY DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. VELOCITY SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES, WARRANTIES AND REPRESENTATIONS, IF ANY, OFFERED BY REWARDS PROGRAM SUPPLIERS OR SERVICE PROVIDERS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY A PARTICIPANT FROM VELOCITY THROUGH THE REWARDS PROGRAM SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
 
Limitation of Liability
VELOCITY SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, RELATING TO THE REWARDS PROGRAM, THE PRODUCTS FOR WHICH POINTS ARE REDEEMED, OR ANY CONSEQUENCES FLOWING THEREFROM OR RELATED THERETO. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MIGHT NOT APPLY TO YOU.
 
Velocity is not responsible for any damages or losses that result from participating or being unable to participate in the Rewards Program, or reliance on or use of information, services or merchandise provided on or through the Rewards Program.
 
Velocity is not responsible for any actions, representations or omissions of Program Sponsors. No third party, including without limitation any Program Sponsor, shall have the authority or ability to change any term or condition of the Rewards Program, and participant shall have no right to rely on any information from any third party with respect to the actual terms and conditions of the Rewards Program.
 
Participants acknowledge and agree that Velocity neither endorses the contents of Program Sponsor advertisements or websites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising therefrom, or any fraud or other crime facilitated thereby.
 
Velocity is not responsible and assumes no liability for any changes or discontinuances of services from providers, which may affect offers or the accrual of Points. Velocity is not responsible and assumes no liability for any unavailability of its website or other technical malfunctions. In no event shall Velocity's liability, either jointly or severally, exceed the amount of $100.
 
Tax Consequences
Participants are responsible for the tax consequences, if any, of their participation in the Rewards Program. Velocity does not make any representations or warranties regarding any tax implications arising from the receipt of Points, the redemption of Points or participation in the Rewards Program. If the receipt of Points, the redemption of Points or participation in the Rewards Program results in any income tax or other tax liability to a participant, all such tax liability will be borne by the participant. Velocity disclaims all responsibility for any such taxes.
 
Force Majeure
In no event shall Velocity be liable or responsible for any breach, default, or delay in the performance of any of its obligations in connection with the Rewards Program occasioned by occurrences or contingencies considered “force majeure” including, but not limited to, delay caused by inability to obtain transportation, inability to obtain materials, delay in transit from a manufacturer or supplier or failure to make delivery by a manufacturer or supplier, shortage of fuel, failure of technology, failure of sources of supplies, breach or default by a supplier, strike, lock out, labor disputes, disasters, fire, flood, accident, invasion, riot, war, revolution, embargo, restraint, acts of God, disease, epidemic, public health crisis, substantial increases in the price of goods, materials, parts, supplies, shipping costs, customs duties, taxes or other costs, failure of electronic equipment, software and/or Internet service, the value of the Chinese yuan or other Chinese currency no longer being tied to the value of the United States dollar, demand of the United States or any other government, failure of participant to perform its obligations under these Rewards Program Terms and Conditions, or any other cause or contingency beyond Velocity's control which shall prevent or materially impair Velocity from performing in the normal and usual course of its business in a profitable fashion.
 
Indemnification
Each participant agrees to indemnify and hold Velocity and Program Sponsor and their respective affiliates, shareholders, directors, officers, employees, successors and assigns harmless from any claim, demand, liability, expense or damage, including reasonable attorneys' fees and expenses, relating to the participant's use of the Rewards Program or violation by the participant of these Rewards Program Terms and Conditions.
 
Governing Law and Jurisdiction
This contract shall be governed by the laws of the State of North Carolina , excluding its conflict of law principles.   Any dispute or claim arising out of or in relation to these Rewards Program Terms and Conditions, or the interpretation, making, performance, breach or termination thereof, shall be finally settled by binding arbitration in Wilmington, North Carolina, under the Commercial Arbitration Rules of the American Arbitration Association by a single arbitrator appointed in accordance with said Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
 
Participant and Velocity agree that, any provision of applicable law notwithstanding, neither party will request, and the arbitrators shall have no authority to award, punitive or exemplary damages against the other party.

Velocity, the Rewards Program, the Points system, the Velocity logo as well as the names of Velocity's products, product features and services are trademarks and/or service marks of Velocity in the United States and other countries. Other products and services mentioned on this website may be the trademarks of their respective owners.

Nothing contained herein shall be construed as conferring, by implication, estoppel or any other legal theory, a license or right to any patent, trademark, copyright or other intellectual property right, except those expressly provided herein. The products, processes, software and other technology described in these Rewards Program Terms and Conditions, on Velocity's website and in Velocity's promotional materials may be the subject of other intellectual property rights owned by Velocity or by third parties and no licenses are granted herein.  You may use the information contained on this site for informational purposes only. Commercial uses are prohibited. You may not change or modify the information in any way that may be adverse to the interests of Velocity.
 
Privacy Policy
Velocity is committed to maintaining the privacy of the Rewards Program participants' personal information. NO CHECKING ACCOUNT NUMBERS, SOCIAL SECURITY NUMBERS OR CREDIT/DEBIT CARD NUMBERS ARE ACCESSIBLE THROUGH THIS WEBSITE. For more information, please see our complete Privacy Policy. Other Terms and Conditions
This Rewards Program Terms and Conditions document constitutes the complete and exclusive understanding between Velocity and the participant relating to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, communications and/or advertising with respect to such subject matter.   If any provision of these Rewards Program Terms and Conditions is held by the arbitrator or other applicable authority to be contrary to law, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
 
Velocity's failure to exercise or enforce any right or provision of these Rewards Program Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Velocity in writing through one of its executive officers. All notices given by Velocity may be given by email, regular mail or by general posting on the Rewards Program website.
 
Merchant “Bonus” Points
Reward program participants may also earn reward merchant “bonus” points by making online purchases through specific merchant links contained within the www.FairfieldCountyBankRewards.com website. These merchant “bonus” points are awarded in addition to the standard point rewards that are described within the reward program terms and conditions. Links to qualifying vendors are available to reward program participants when logged in to their online reward account. Only online purchases made through the provided links qualify for earning merchant “bonus” points. Future purchases must also be made through the provided links (within the www.FairfieldCountyBankRewards.com website) in order to earn reward merchant “bonus” points. Purchases made using merchant-issued coupons or discounts not found on the www.FairfieldCountyBankRewards.com website are not eligible to earn merchant “bonus” reward points. Use of coupons and discounts may vary and are controlled by each individual merchant. Purchases do not have to be made in increments of $100.00 to be eligible to earn points. Points earned are based on a percentage of the purchase price (and vary by merchant), not including taxes or shipping and handling charges. Merchant “bonus” points earned will be emailed to the email address stored in your account information (directly by the merchant) approximately 45 calendar days after the end of the month of the date of purchase. The merchant “bonus” reward points will be in the form of an electronic certificate. Merchants will specify electronic certificate expiration dates. Reward program participants are required to input reward point certificates into their online reward accounts in order to claim reward merchant “bonus” points.
